These Terms of Use govern your access to and use of the One Stop Home Care Agency, LLC website, located at www.onestophomecareagency.com, including its webpages, forms, member resources, and related online features collectively referred to as the “Site.”

By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

1. About This Site
The Site is operated by One Stop Home Care Agency, LLC (“One Stop,” “we,” “us,” or “our”). It provides general information about our agency, home care services, Medicaid and Managed Long Term Care (“MLTC”), employment opportunities, educational resources, consultation requests, and resources for authorized workforce members.
Information on the Site is provided for general informational and administrative purposes. It is not a substitute for an individual assessment, formal service agreement, insurance determination, or professional medical advice.
2. No Medical Advice or Emergency Services
The Site does not provide medical advice, diagnosis, treatment, or emergency services. Information concerning health, personal care, Medicaid, MLTC, or other healthcare topics is general in nature and should not replace guidance from a qualified healthcare professional, government agency, or insurance plan.
Do not use the Site, its forms, email, or member resources to report an emergency or request urgent medical assistance.
If you or someone else may be experiencing a medical emergency, call 911 immediately.
3. No Guarantee of Eligibility, Coverage, or Services
One Stop may explain available options and help individuals and families understand the Medicaid, MLTC, assessment, and home care process. However:

• Medicaid eligibility is determined by the applicable government agency.

• MLTC enrollment, benefits, assessments, and service authorizations are determined by the applicable MLTC or insurance plan.

• Approved home care hours are determined by the responsible plan or authorizing organization.

• Any estimate discussed by One Stop is for general guidance and is not a guarantee.

• Submitting a consultation request or other form does not guarantee eligibility, enrollment, acceptance as a patient or member, service authorization, caregiver availability, or a particular number of service hours.

A formal care relationship begins only after all required assessments, authorizations, documentation, agency acceptance procedures, and service agreements have been completed.
4. Third-Party Plans and Providers
The Site may identify or provide information about MLTC plans, insurance plans, healthcare providers, referral partners, government programs, or organizations such as Intention Health Care.
These organizations operate independently and determine their own eligibility requirements, coverage, enrollment, clinical services, and decisions. Mentioning an organization on the Site does not guarantee enrollment, coverage, acceptance, availability, or a particular outcome.
Other MLTC or insurance plans not listed on the Site may also be accepted. Please contact One Stop so that we can review your information and help determine the appropriate next step.
5. Information and Forms You Submit
You agree that information submitted through the Site will be accurate and complete to the best of your knowledge.
If you submit information on behalf of another person, you represent that you have permission or legal authority to do so. You may not impersonate another person, submit fraudulent information, or access another person’s information without authorization.
Please do not submit Social Security numbers, complete medical records, detailed medical information, insurance identification numbers, financial information, or other highly sensitive information through a general contact form unless the form specifically requests it and has been designated by One Stop for that purpose.
Submitting a form does not guarantee that One Stop has received or reviewed it. If your matter is time-sensitive, please call us at 718-808-9908.
6. Communications
When you submit your telephone number, email address, or other contact information, you authorize One Stop to contact you regarding your inquiry, consultation request, application, services, or agency-related matter.
Communications may be made by telephone, email, or text message when appropriate and permitted by law. Standard telephone or messaging rates may apply.
Providing contact information for an inquiry does not require you to enroll in services or consent to unrelated marketing communications.
Email and ordinary text messaging may not always be secure. Do not send sensitive health or personal information through an unsecured communication method unless instructed to do so by an authorized One Stop representative.
7. Career Applications
Career information and job postings on the Site are provided for informational purposes and may be changed, filled, suspended, or withdrawn at any time.
Submitting an employment application:

• Does not guarantee an interview or employment;

• Does not create an employment contract;

• Does not alter the at-will nature of employment where applicable; and

• Does not guarantee assignment to a particular office, location, schedule, patient, or case.

Employment decisions remain subject to interviews, credential verification, background checks, reference checks, work authorization, licensing requirements, and other applicable agency policies and legal requirements.
8. Member Resources and Account Security
Certain areas of the Site may be limited to authorized employees, contractors, caregivers, nurses, coordinators, managers, or other approved users.
If you receive account credentials or access to member resources, you agree to:

• Keep your username and password confidential;

• Use the account only for authorized agency purposes;

• Never share access with an unauthorized person;

• Access, download, or disclose information only when required for your assigned responsibilities;

• Log out when using a shared or public device;

• Immediately report suspected unauthorized access or a lost or compromised password; and

• Follow all applicable One Stop privacy, confidentiality, cybersecurity, recordkeeping, and workforce policies.

Access to member resources may be suspended or terminated when necessary to protect agency systems, confidential information, patients, workforce members, or other users.
These Terms do not replace any employment agreement, confidentiality agreement, agency policy, training requirement, or other agreement applicable to an authorized workforce member.
9. Acceptable Use
You may use the Site only for lawful purposes. You may not:

• Attempt to gain unauthorized access to an account, system, file, or restricted area;

• Use another person’s credentials;

• Interfere with the Site’s operation or security;

• Introduce viruses, malicious code, or harmful technology;

• Scrape, copy, harvest, or collect information through automated means without permission;

• Submit false, misleading, fraudulent, threatening, discriminatory, or unlawful content;

• Violate another person’s privacy, confidentiality, intellectual property, or legal rights;

• Use Site content for unauthorized commercial purposes; or

• Use the Site in a manner that violates applicable laws, regulations, or agency policies.

10. Intellectual Property
The Site and its content—including its text, logos, graphics, photographs, documents, layout, branding, and other materials—are owned by or licensed to One Stop and are protected by applicable intellectual property laws.
You may view and print Site materials for personal, noncommercial, or properly authorized agency use. You may not reproduce, modify, distribute, sell, publish, display, or create derivative works from Site content without prior written permission from One Stop, except as permitted by law.
11. Third-Party Websites and Work Tools
The Site may link to third-party websites, platforms, or tools, including SharePoint, HHAeXchange, Slack, KakaoTalk, Adobe, insurance-plan websites, and government resources.
These third parties maintain their own terms, privacy practices, security controls, and availability. One Stop does not control every third-party platform and is not responsible for its independent content, policies, technical operation, or availability.
A link is provided for convenience and does not necessarily constitute an endorsement. You should review the applicable third party’s terms and privacy notices before using its services.
12. Privacy and Protected Health Information
Use of the Site is also subject to our Privacy Policy.
When information constitutes protected health information, its use and disclosure will also be governed by applicable law and One Stop’s Notice of Privacy Practices. These Terms of Use do not authorize any use or disclosure prohibited by applicable privacy laws.
If there is a conflict between these Terms and rights or obligations imposed by applicable law, applicable law will control.
13. Website Availability and Accuracy
We make reasonable efforts to keep the Site accurate and available. However, information may occasionally be incomplete, outdated, unavailable, or contain typographical or technical errors.
We may update, suspend, restrict, or discontinue any part of the Site without notice when reasonably necessary. We do not guarantee that the Site will always operate without interruption, delay, error, or security risk.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis.
One Stop makes no guarantee that:

• The Site will be uninterrupted or error-free;

• All information will always be complete or current;

• Use of the Site will result in Medicaid eligibility, MLTC enrollment, insurance coverage, employment, or home care authorization; or

• Third-party links, services, or platforms will remain available.

Nothing in this section limits a warranty or right that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, One Stop will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from your access to, use of, or inability to use the Site or a third-party link.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, limits legally protected patient or consumer rights, or prevents an individual from filing a complaint with One Stop, an MLTC plan, the New York State Department of Health, another government agency, or law enforcement.
16. Suspension or Termination of Access
We may restrict, suspend, or terminate access to the Site or member resources if we reasonably believe that a user has violated these Terms, created a security risk, accessed information without authorization, or used the Site unlawfully.
Provisions concerning confidentiality, intellectual property, disclaimers, liability, and governing law will remain effective after access ends.
17. Changes to These Terms
We may revise these Terms of Use periodically. The updated version will be posted on this page with a revised effective date.
Your continued use of the Site after revised Terms become effective means that you accept the updated Terms. When required by law, we will provide additional notice or obtain consent before applying a material change.
18. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings relating specifically to use of the Site will be brought in a court with appropriate jurisdiction in New York.
Nothing in these Terms limits any right to contact or file a complaint with a healthcare plan, regulatory authority, government agency, or law-enforcement organization.
19. Severability and No Waiver
If any part of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain in effect.
A failure by One Stop to enforce a provision does not waive our right to enforce that provision later.
